Mobile Terms of Service

Apotheca, Inc. ("Apotheca," "we," "us," or "our") offers a mobile messaging program to provide B2B wholesale communications, order notifications, logistics updates, and promotional alerts (the "Program"). By opting in to or participating in the Program, you accept and agree to these Mobile Terms of Service and our general Terms of Service and Privacy Policy.

1. Program Description & Consent

Apotheca sends transactional and marketing text messages to registered B2B clients who have explicitly consented to receive them. These messages may include:

  • Transactional & Logistics Alerts: Order confirmations, shipment tracking numbers, cold chain storage alerts, billing notifications, and professional license renewal reminders.
  • Marketing & Promotional Campaigns: Information regarding new product arrivals, volume discounts, medical supply availability, and B2B wholesale promotions.

By providing your mobile phone number and opting in to the Program via our registration forms, partner applications, or contact requests, you represent that you are the authorized user of the mobile number provided and have the authority to consent to receive recurring automated text messages at that number.

2. Message Frequency

Message frequency varies based on your B2B account activity and interaction with our services. Transactional alerts are sent dynamically in response to account actions (e.g., order submissions, delivery statuses). Marketing and promotional campaigns will not exceed a maximum frequency of ten (10) messages per calendar month.

3. Message & Data Rates

Apotheca does not charge a fee to participate in the Program. However, standard message and data rates may apply from your wireless carrier. Your carrier's standard rates for text messaging, data usage, and roaming will apply to all text interactions. Please check your mobile service plan or contact your wireless provider for details on messaging rates.

4. Opt-Out (STOP) Instructions

You can cancel your participation in the Program at any time. To stop receiving text messages from Apotheca, reply STOP (or quit, end, unsubscribe, cancel) to any mobile message received from us. You may also contact our support team at customerservice@apotheca-inc.com and request to be removed from our text marketing lists.

Following your request to opt out, you will receive a single, automated text message confirming that you have been unsubscribed from the Program. No further messages will be sent to your mobile device unless you explicitly opt in again.

5. Help (HELP) Instructions

If you need assistance or are experiencing issues with our mobile messaging service, reply HELP to any message received from us, call our customer support line at (602) 252-5244, or email us at customerservice@apotheca-inc.com. Please include your business name, account identifier, and the mobile phone number associated with the request.

6. Carrier Liability Disclaimer

Mobile carriers (including, but not limited to, AT&T, T-Mobile, Verizon, Sprint, and regional networks) are not liable for delayed or undelivered messages. Delivery of text messages is subject to effective transmission from your wireless network operator and is outside the direct control of Apotheca.

7. Privacy & Information Security

Apotheca respects your business privacy. We handle all mobile number data in accordance with our Privacy Policy. Please review our specific SMS data protection commitments:

  • No Sharing for Marketing: Your mobile phone number, opt-in data, and SMS consent records will not be shared, sold, rented, leased, or disclosed to third parties, partners, or affiliates for marketing or promotional purposes under any circumstances.
  • Service Provider Limitations: We may share your mobile number with trusted third-party service providers (such as SMS gateway providers or delivery APIs) solely to transmit Program messages on our behalf. These service providers are legally bound to protect your data and are strictly prohibited from using your information for their own purposes or sharing it further.
  • Compliance Logging: Consistent with TCPA requirements and carrier rules, we maintain records of your opt-in consent (including date, time, source form, and IP address) and opt-out requests for audit and compliance verification purposes.
